The U.S. Citizenship and Immigration Services (USCIS) will start premium processing for H-1B petitions that are subject to cap from 27 April 2015. The petitions requesting an exemption for candidates with a US master’s degree or higher is inclusive in the list.
USCIS announces that it would adjust its premium processing temporarily due to the significant premium processing receipt levels, with the probability that the H-1B cap will fill within first five business days of the filing season.
It also mentions that USCIS offers premium processing service for few employment-based petitions and ensures to process applications within 15 calendar days.
On the other hand, the H-1B petitions are not subject to cap neither it falls under any other visa classification, the 15-day processing time for premium processing start from the day when USCIS gets the request.
Nonetheless, in case of cap-subject H-1B petitions including applications filed under advanced degree exemption, the 15-day processing timeframe set by 8 CFR 103.7(e)(2) will start from 27 April 2015, irrespective of the date of submission of Form I-797. It means the date on which premium processing fee is collected.
