"Client" or "you" or "your" or "their" or "them" means the individual visiting this Website

"My Store" means the secure online system managed by Opulentus which allows Clients to enter and their personal information and access our Service (s) or purchase our Product (s) from any computer with internet access.

"Opulentus" or "we" or "our" or "us" means Opulentus Overseas Careers or any of our subsidiary companies.

"Profile" means the information provided by the Client about the Client and, if applicable, about the Client's family.

Licence and Website Access

Opulentus grants you a limited licence to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Opulentus Overseas Careers. Opulentus does not warrant that this website, its servers, or e-mail sent from Opulentus are free of error, viruses or other harmful components. Opulentus_uk.com will not be liable for any damages of any kind arising from the use of this website, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

To the extent that liability cannot be excluded, the liability of Opulentus, its directors, officers, employees, and consultants is limited to the cost of the service Opulentus provides to the Client.

To the greatest extent possible by law, the Client must indemnify and hold harmless Opulentus, its officers, employees, agents and related companies (Indemnified Persons) against all Liabilities (including legal costs on a full indemnity basis) incurred by the Indemnified Person in connection with the provision of the Service by Opulentus, except the Liability arising from the negligence or default of any of the Indemnified Persons.

2. TERMS OF SERVICE

Limitations of Service

Your Consultant will provide advice based on the specific information you supply within the Opulentus application form, hence if limited detail is available, certain assumptions may be necessary.

As cases can vary considerably from client to client, any guidance or comments are personal and intended only for you and should not be applied to the circumstances of any third party.

The advice provided by your Consultant is communicated on the belief that it reflects current immigration laws, policies and regulations as on the date of signing the agreement.

Whilst Opulentus Overseas Careers and its Consultants endeavour to offer the best possible advice; immigration laws, policies & fees are subject to frequent change without notice and no responsibility is accepted for any errors in the guidance and information provided, typographic or otherwise.

Opulentus Overseas Careers does not and cannot make any guarantees in context of approval or validity of any visa application made by you or by Opulentus on your behalf. The power to grant or refuse visa applications vests solely with the government department only.

Opulentus Overseas Careers will just assist you in a limited manner for filing application for immigration and will not provide taxation, business, accounting, investment or other professional advice or services. Opulentus advises clients to seek separate independent professional advice regarding these matters.

Communications

When you visit Opulentus Overseas Careers, send e-mail (s) to us or communicate with us through any other mode (s) of communication; you agree that all such communications (including agreements, notices, disclosure, etc.) satisfy all legal requirements to be in writing.

We will communicate with you by e-mails or by posting notices on this Website. If you do not respond to any communication related to the provision of the Service within two (2) working days, we will prepare the Service based on the information previously provided by you.

Your Profile

Accessing this website makes you responsible for maintaining the confidentiality of your Profile and password, restricting access to your computer and you agree to accept responsibility for all activities that occur under your Profile or password.

When accessing My Store, you are required to enter your email/username and password each time. Access to your Profile is protected by your email/ username and password hence it is very important that you protect your password by making it known ONLY to you. To protect your personal details, we recommend that you do not disclose your password to anyone, including family members and friends.

Opulentus Overseas Careers will not be held responsible for any access gained by third parties to your personal Profile, whether the login details were provided by you or were otherwise obtained.

Initial Review Report

The Initial Review Report is specifically designed to provide you with a preliminary assessment of your ability to satisfy the Visa criteria for your selected visa/permit type. Client understands that the Report was made based on the information that was provided. This needs to be supported by valid documentation. As such you should not rely on this result alone as a true indication of your ability to apply for migration.

Information Provided by the Client

Opulentus Overseas Careers will use and rely on information provided by the Client in the provision of the Service. Opulentus will not independently verify or assume responsibility for the accuracy or completeness of such information. Accordingly, the information provided by the Client must be correct; including date of birth, qualifications and work history, contact details, etc. If the information provided by the Client is not correct, the Service may not be accurate.

Any advice provided to you should not be used by any third party as each case varies depending on the particular circumstances of the applicant and the applicant's family. Such action will result in an immediate breach of our Copyright terms as set out above.

Provision of Service

Upon registering your interest, you are able to purchase a Service or Product offered by us. Upon payment, we will endeavour to have the Service delivered to you within the time frame provided for in the Service description. However, in certain cases this may take longer, depending on the complexity of the Client's Profile.

The Service also takes into account current and publicly available immigration legislation and policies. Opulentus cannot be held responsible for any inaccuracy arising from changes in such legislation and policy which are not publicly available at the time the Service is provided or which may occur after the Service has been provided to the Client.

The Client is encouraged to seek additional guidance from one of our Immigration Consultants and/or make independent enquiries before relying on the information provided as part of the Service.

Opulentus Overseas Careers cannot offer taxation, business, education or investment advice. Any information provided by our employees on non-migration related matters should only be interpreted as general information and the Client should obtain professional advice regarding these matters.

Types of Services

Opulentus Overseas Careers offers a selection of Services which vary depending on the country a person is seeking to migrate to. Opulentus reserves the right not to respond to questions that:

  • do not relate to migration matters; or
  • are not submitted in English; or
  • are not related to the Client's Profile; or
  • are not appropriate

If multiple questions are submitted in one session, Opulentus reserves the right to request that the Client resubmit the questions separately, or to limit the amount of questions asked in a 24-hour period.

Guarantee of Visa

We are not part of any government. We are a private company and we do not have the authority to grant you a visa of any kind. We can only assist and advice people who want to migrate or travel to their selected country. Please note that the final decision on all visa applications rests with the relevant government department in each respective country.

Fees Payable

Any fees paid to Opulentus Overseas Careers are for the provision of the Service/s listed on our Website. You are responsible for paying all fees and applicable taxes associated with our Services using one of our accepted payment methods.

Our fee does NOT include other costs which are part of the migration process such as government lodging fees, medical and police checks, translation of documents, etc. As part of the Service (s) which is/are provided to you, an approximate indication of the fees which form part of the process will be set out for you, together with clarification as to when these costs are due.

Refund Policy

  • i)     Refund in case of rejection by the Skills Assessing Authority/Immigration and Visa Authorities In case of rejection by the Skills Assessing Authority/Immigration and Visa Authorities, Opulentus Overseas Careers will refund the applicable amount as per stated in the agreement. The refund will be made within 60 working days after the client submits 'Opulentus Overseas Careers Refund Claim Form' to Opulentus. Client will enclose a copy of the letter of rejection from the Authority to support the Refund Claim. If client does not enclose a copy of the rejection letter or rejection stamp on the client's passport, Opulentus will not refund applicable refund amount. Client will also enclose with the refund request form, a copy of his receipt for payment made to Opulentus. Failure to enclose this will also make the client ineligible for the refund.
  • ii)     Opulentus Overseas Careers will provide no refund if the visa is rejected for any of the following reasons:
  • Failure of medicals by the client or his or her family members included in the application
  • Failure to provide a genuine Police Clearance Certificate, which is not less than 3 months old
  • Failure to prove sufficient funds for settlement by the client or his or her family members included in the application
  • Submission of fraudulent documents
  • Prior violation of any immigration or visa law by the client or any of his or her family members included in the application
  • Late submission of any additional documents requested by the consulate at a later stage.
  • iii)     Opulentus Overseas Careers will provide NO refund for any of the following reasons:
  • if a visa interview is requested by the Skills Assessment, Immigration or Visa Authority and the candidate fails to attend
  • if the client fails to get the required score in IELTS to meet the eligibility criteria and as advised by the Opulentus consultant
  • if the client abandons his/her case within 3 months from the date of registration.(Non communication with your consultant for a period of 3 months shall also be deemed to be abandonment)
  • iv)     Other Instances of Refund
  • In the event that the immigration law changes anytime after you have signed the agreement OR anytime during the processing of your application & due to this change of law, you have become ineligible to apply for the service you have signed up for, and you have paid the ENTIRE amount; Opulentus will refund a certain percent of the Opulentus Overseas Careers service fee paid by the client as specified in the agreement. The refund will be made within 60 working days after the client submits 'Opulentus Overseas Careers Refund Claim Form' to Opulentus. Client will enclose with the refund request form, a copy of his receipt for payment made to Opulentus. Failure to enclose this will also make the client ineligible for the refund.
  • In the event that you have signed up for Opulentus service under the INSTALMENT PAYMENT OPTION or MADE A PART PAYMENT and the immigration law changes anytime after you have signed this agreement OR anytime during the processing of your application & due to this change of law, you are now ineligible to apply for the service you have signed up for. In this case client will not be entitled to a refund of any fees previously paid as the first instalment or any other part payment to Opulentus.
  • In the event that you have signed up for Opulentus service under the INSTALMENT PAYMENT OPTION or MADE A PART PAYMENT and the immigration law changes anytime after you have signed this agreement OR anytime during the processing of your application & due to this change of law, you are now ineligible to apply for the service you have signed up for. In this case client will not be entitled to a refund of any fees previously paid as the first instalment or any other part payment to Opulentus.
  • iv)     v) No Refund in case of Withdrawal/Conversion/Transfer
  • Client understands and accepts that no refund will be given if the client withdraws / abandons his/her application or decides to drop out, due to any reason, during the proceedings after he or she signs-up
  • Client also understands and accepts that no refund or adjustment of Opulentus fee will be done in the event he or she abandons the original service / process he or she has signed-up for and decides to switch over to another service / process with Opulentus or opts for immigration to a different country
  • Client also understands and accepts that no refund or transfer of Opulentus fee to a friend or a relative will be done in the event he or she abandons his or her application or decides to drop out due to any reason, during the proceedings after he or she signs-up.

Termination of Service

Opulentus Overseas Careers reserves the right to terminate this agreement at any time. Termination includes cancelling your registration with or ability to have full or partial access to this Website and/or any other service provided to you by us.

Opulentus reserves the right to terminate this agreement for any reason, including any improper use of this Website; the provision of false or misleading information; or your failure to comply with these terms and conditions.

Complaints

In case the user has any complaint (s) regarding our services or processes then he/she can approach us and get registered the same. Opulentus Overseas Careers Complaints are handled by a team dedicated to resolve the queries and issues of clients regarding Opulentus. This team makes sure to cater to complaints in best possible manner and provide solutions which result in best services to clients.

Only genuine complaints are dealt by our team. Opulentus Overseas Careers Complaints which are not genuine and are a result of client's own negligence or fault is not catered by Opulentus. Such non genuine complaints can be rejection of visa which can be due to non submission of documents from client's side, absence of client on interview date at immigration office resulting in visa rejection etc. In such cases, Opulentus Overseas Careers will not be responsible and complaints relating to these will not be adhered to.

Privacy and Release of Information

Opulentus Overseas Careers takes reasonable steps to protect personal information (as defined under the Privacy Act) collected by Opulentus from misuse and loss and from unauthorised access, modification or disclosure.

Opulentus may use and disclose the Client's (and if applicable, the Client's family's) personal information for the primary purpose for which it is collected, for reasonably expected secondary purposes which are related to the primary purpose and in other circumstances authorised by the Privacy Act.

In general, Opulentus will disclose the Client's personal information for the following purposes:

  • to conduct our business;
  • to provide and market our services;
  • to communicate with the Client;
  • to comply with our legal obligations; and
  • to help us manage and improve our services

Subject to the exceptions set out in the Privacy Act, the Client may gain access to the personal information which Opulentus holds about them by sending a message via the Client Area. A fee may be charged for providing access and Opulentus will advise the Client of the likely cost in advance.

Due to privacy laws, we are unable to discuss your personal details with any third party enquiring on your behalf (including family) unless you provide your written consent authorising us to do so.

Governing Law

The agreement Terms shall be governed by the laws of India. The Courts of India shall have exclusive jurisdiction to settle any disputes (including claims of set-off and counterclaims) in connection with this Agreement.

General

No person has been authorised to give any representations on behalf of Opulentus Overseas Careers in regards to the subject matter or the terms of these Terms.

Headings in these Terms are for convenience only and do not affect the interpretation of these Terms.

Opulentus may vary any of these Terms and any other information relating to the Service at any time, and your subsequent use of the Website will be governed by the varied Terms.

In the event that any of the provisions of these Terms are or shall become invalid, illegal or unenforceable, the remainder shall survive unaffected.

3. PRIVACY POLICY

Sharing

We may share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can divulge the identity of our clients.

We share customer information only as described below:

  • With subsidiaries or associated companies of Opulentus that either are subject to this Privacy Policy or follow practices at least as protective as those described in this Privacy Notice.
  • Business Transfers: As we continue to develop our business, we might sell or buy businesses or subsidiaries. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless, of course, the customer consents otherwise). Also, in the unlikely event that Opulentus or substantially all of its assets are acquired; customer information will of course be one of the transferred assets.
  • Protection of Opulentus Overseas Careers and Others: We release account and other personal information when collection is required by law or when the information is necessary for the establishment, exercise or defence of a legal claim.

Opulentus may disclose the Client's personal or sensitive information (as defined in the Privacy Act):

  • to regulatory authorities;
  • where the law requires us to do so; and
  • where the Client consents for us to do so
