New immigration regulations do aim at clarifying parts of the 457 Visa Program in Australia, which is due to be introduced at the start of December.

The major aim is to provide greater transparency to work agreements, and it is largely responsive to the recent negotiation around the implementation of CHAFTA, the China-Australia Free Trade Agreement.

The change introduced to subclass 457 visa holder should obtain mandatory licensing or registration within strict time limits, and they should notify the immigration dept if their registration or licensing ceases.

As per the newly laid terms as well as conditions of employment of subclass 457 visa holders who are employed by a business should be equal to those in any enterprise agreement for that particular workplace.

Details are required to be published by Peter Dutton, Minister for Immigration and Border Protection, along with guidelines on work agreements and project agreements.

The changes should clarify pay market rates that should be paid in work places operating under enterprise agreements. They should also clarify the needs in order to obtain as well as hold mandatory licenses or registration.

It means that those individuals working in Australia with a 457 visa should obtain their license or registration within 90 days of arriving in the nation or within 90 days of their visa being offered if they were already in Australia.

It also means that 457 visa holder should begin work within 90 days of arriving in the nation or within 90 days of being offered visa if already in Australia at the time it was applied for.

The regulations set should be clear that business should have made recent as well as genuine effort to recruit an Australian Citizen or Permanent Resident before being able to employ someone from overseas.

The DIBP has also announced changes to health check required for all visa application. Most temporary visas do require health checks only were the special circumstances apply. Now it is more likely that a short trip could trigger health checks.
