A settlement has been accepted in a class-action lawsuit produced on behalf of previous Quebec Skilled Worker Program applicants against Immigration Ministry of Quebec.
The class-action attempted compensation for applicants of Quebec Skilled Worker Program (Q.S.W.P.) who paid the application fee for a Quebec Selection Certificate (C.S.Q.) but were later rejected by the reforms to the Quebec province’s selection criteria that came into force on 1 August 2013, and 8 March 2017.
The lawsuit claimed that the Quebec Immigration Ministry and the Quebec Government were wrongly enriched, committed a fault and performed in bad faith by declining to offer to refund the fees of application, a notice issued on the website of ministry reads.
The Superior Court of Quebec authorized the class action on February 2018, and a settlement was accepted last month.
Earlier Q.S.W.P. applicants who fall in one of the below groups may now be qualified for compensation:
Group 1: People whose C.S.Q. Applications were submitted between 1 Feb 2012, and 31 May 2013; whose C.S.Q application included an immigration form A-1520-AA or A-1520-AF showing that their C.S.Q application would be treated in accordance with the laws in force at the time of registering with Immigration Ministry of Quebec and whose C.S.Q appeal was rejected following to the effect of the selection grid on 1 Aug 2013.
Group 2: People whose C.S.Q. Applications were submitted prior to 1 Feb 2012, or between 1 Jun 2013, and 7 Jul 2013, and whose C.S.Q appeal was rejected following to the effect of the selection grid on 1 Aug 2013.
Group 3: People whose C.S.Q. Applications were submitted between 8 Jul 2013, and 8 Mar 2017, and whose C.S.Q appeal was rejected following to the effect of the selection grid on 8 Mar 2017.
