In our previous article, we suggested there would be modifications made that would affect partner visa appeals, specifically, the how and when a candidate will be able to lodge with the Australia Home Affairs Department and potential ramifications.
Following current developments, these modifications will take effect prior to 10 Jun 2019 although the specific date is yet unknown. It means the reform can be achieved at any moment prior to 10 Jun 2019.
Part of the guidelines for Partner visa PR requires the visa aspirant to be sponsored by a citizen of Australia, permanent resident of Australia or qualified New Zealand citizen. Together, the visa aspirant and their partner present their requests to the Home Affairs Department.
Providing a genuine Australia partner visa while in Australia enables the visa aspirant to get a Bridging Visa A which will get the outcome when their active visa expires. The holder of BVA will then be able to continue in Australia until a decision is given on the partner appeal. During this time of processing, the holder of BVA will also be empowered to Medicare and have entire rights to work.
The new modification will need the Australian partner to submit their appeal and have this accepted prior to the partner visa appeal can be lodged.
It is not at all clear that how long the process of decision for the appeal of the sponsorship may take. Modern process times are roughly 12 - 18 months.
The modifications are to effect prior to 10 Jun 2019 but, no additional details have been published regarding the specific date. We recommend that eligible applicants are seeing to lodge while in Australia, do so as soon as feasible.
