The new law has currently been introduced that will significantly affect whether a Partner visa application of Australia can be lodged while the candidate (spouse or partner) is in Australia.
On 10 Dec 2018, the current Migration Amendment (Other Measures and Family Violence) Bill was passed by Parliament.
It has not yet been approved when the current legislation will take effect. Applications of Partner visa lodged till the reforms come into effect will be evaluated below the present requirements of partner visa application.
Partner visa candidates with short time remaining on their present visa will be needed to either lodge different visa application that will enable them to live in Australia legally, or go offshore and stay abroad till the partner visa is given.
Part of the guidelines for Partner PR needs the visa candidate to be sponsored by a permanent resident of Australia, Citizen of Australia or qualified New Zealand citizen. Presently, the visa candidate and their partner apply to the Immigration Department.
When a genuine partner visa appeal is lodged while legally residing in Australia, you will be announced with a Bridging Visa A (B.V.A).
When your B.V.A is connected with your lodged partner visa appears into effect, you are able to work full time and will be allowed for Medicare also.
The current Bill needs the partner first to lodge their application of sponsorship and be approved prior partner visa can be submitted.
It is unclear how long the judgment process of the sponsorship appeal will take, present process times are around 12 to 18 months.
