British Columbia will set new rules covering the approximately 20,000 temporary foreign workers aiming to work in the Canadian province each year.
The BC province newly passed Bill 48, the B.C Temporary Foreign Worker Protection Act, which will view the registries creation for companies and recruiters who plan to utilize the Program of Temporary Foreign Worker.
Through T.F.W.P, organizations get Temporary Foreign Workers to Canada to do works for which they are not able to find citizens of Canada or permanent residents of Canada.
A significant part of the process is getting a positive Assessment of Labour Market Impact (L.M.I.A), which includes stringent requirements along with a mandatory job promotion period.
Bill 48 obtained a royal evaluation in Nov 2018. Regulations are assumed priorly in the year 2019 to get the act into force.
The implementation will involve recruiters and businesses must be licensed, while companies must hold the registration of provincial government certificates.
Enrollment will be online and free, with both licenses and certificates valid for a tenure of 03 years. The act also grants for development of implementation tools possible to officials of BC province.
It expressly bans specific practices, such as misrepresenting the opportunities of employment, warning deportation without a problem, and taking passports.
Stricter penalties for those who break the act involve fines of up to $50,000 for specific employers, as well as one year in jail, while organizations face penalties of up to $100,000.
Below the act, recruiters may only demand employers for their services of recruiting. Companies are also prevented from recovering recruiting costs from workers via the decrease of wages or benefits.
