Be Ready To File US H-1B Visa Petitions For Fiscal Year 2016

The United States has declared that individuals can file the H-1B visa applications for FY 2016 till 1 April 2015. The petitions for H-1B visa for New Year that commences on 1 October 2015 will be received by the US government starting from 1 April 2015.

USCIS (United States Citizenship and Immigration Services) continues to intake latest H-1B visa petitions after 1 April 2015, however, only till the H-1B cap is filled.

In 2015, the US is likely to reach the cap as soon as possible i.e. within the initial week of April. After the cap has been filled, employers will not be able to file new H-1B visa petitions till 1 April 2016.

The government has placed a limit on H-1B visas for the fiscal year 2016. The cap for H-1B visas is 65,000, with an extra 20,000 visas obtainable for people who have gained a master’s degree or higher degree from a certified US educational institution.

One can’t forecast, when H-1B quota will be filled, however, because of the enhancing economy, it is expected to reach within the first week itself.  Thus, employers are suggested to be ready with their H-1B sponsorship decisions in the coming few weeks. It is significant to get ready with H-1B petitions as soon as possible and fit prior to 1 April 2015, so that an entire petition may be submitted to the United States Citizenship and Immigration Services on the initial day that the quota starts.                                 

Each H-1B visa petition needs certification by the DOL (Department of Labor) of Labor Condition Application (LCA). DOL rules enable for a maximum period of seven working days to certify Labor Condition Application. Thus, it is significant to start work on new H-1B visa petitions immediately.
