Immigration, Refugees, and Citizenship Canada have recently announced that the spouses and common-law partners who have been backed up for migrating to Canada will no longer require a period of conditional PR status. As an alternative, they will be getting a complete PR status upon landing in the maple leaf country. The dismissal of the conditional PR provision was confirmed on April 28, 2017.
By abolishing this condition, the government mentioned that it was addressing the concerns which susceptible sponsored spouses or legal partners might stay in an abusive relationship because they are scared of losing their PR status, although an exemption to the condition was present there for those types of situations. The abuse could be in any form be it physical, sexual, psychological, and/or financial.
The situation was primarily been introduced by the earlier Conservative government in the month of October 2012 as a measure to discourage individuals from pursuing to migrate to Canada through any non-genuine associations.
Though the present administration acknowledges that cases of marriage fraud do exist, but it also conditions that ‘the majority of relationships are genuine and most spousal sponsorship applications are made in good faith, eliminating conditional permanent residence upholds the Government’s commitment to family reunification and supports gender equality and combating gender violence.’
