Lawsuit Settlement On Immigration Ministry Of Quebec Expected In June

The settlement in a class-action action upon the Immigration Ministry of Quebec will be up for court permission in June.
The class action seeks repayment for
Quebec Skilled Worker Program applicants who paid the fee for application of Quebec Selection Certificate (C.S.Q) but were later invalidated by reforms to the selection criteria of the province that came into force on Aug 1, 2013, and Mar 8, 2017.
The case claimed that the Quebec Government and Immigration Ministry were wrongly enriched also committed a mistake and performed in bad faith by denying to grant to reimburse the fees of application, a notice issued April 11 on the website of the ministry.
The Quebec Superior Court authorized the class action in Feb 2018, and a settlement that could repay up to 50% of the fees of application paid was attained between the Quebec Immigration Ministry lawyers and plaintiffs’ legal representatives.
The petition for court permission of the settlement will be heard Jun 19, 2019, in Montreal. The notice states the hearing will decide whether the settlement contract is appropriate and sensible and in the right importance of the Members of Class.
If you are qualified for one of the 03 groups comprised by the settlement and accept of the settlement contract, the notice states no action is needed at this time.
Class Action Qualification and Settlement Contract
The class action identifies 03 groups of people who may be qualified for compensation:
Group 1: People whose CSQ petitions were filed within Feb 1, 2012 to May 31, 2013; whose C.S.Q application included an A-1520-AF or A-1520-AA immigration form designating that their C.S.Q appeal would be treated under regulations and whose C.S.Q application was rejected after the entry into selection grid force on Aug 1, 2013.
Group 2: People whose application for a C.S.Q was filed prior to Feb 1, 2012, or within Jun 1, 2013, and Jul 7, 2013, and whose C.S.Q appeal was rejected after the entry into selection grid force on Aug 1, 2013.
Group 3: People whose appeal for a C.S.Q was filed within Jul 8, 2013, and Mar 8, 2017, and whose C.S.Q application was rejected after the entry into selection grid force on Mar 8, 2017.
Below the settlement agreement terms, partial repayment would be announced as follows:
Group 1: 50% of the application fees paid by a Group 1 member to present his or her application of C.S.Q ;
Group 2: 25% of the application fees paid by a Group 2 member to present his or her application of C.S.Q;
Group 3: 25% of the application fees paid by a Group 3 member to present his or her application of C.S.Q.
