Plans To Streamline Visa Application And Offer More Protection For H-1B Workers

As per the Memorandum on Visa modernization, the latest component of President’s executive action on immigration, US citizenship and immigration services would be soon offering more protection for H-1B visa workers. At the same time, it also like streamlines more applications by using the paperless technology in order to improve the efficiency of the system.

Even though the issue as to how to issue the Green card faster to the immigrants who are waiting in line on EB2 and EB3 route still remains concern. The new set of proposed changes is to make the immigration system more efficient, however we find, there no take on, how to reduce the backlog, perhaps the most critical issue, which remains to be sore point for millions of legal residents on the path to permanent resident status.

• For those individuals whose employment visa petitions are approved for above a year, to retain eligibility for LPR status eventhough petitioning the employer closing its business or seeking it to withdraw the approved petition. To facilitate increase guidance on maximum period of admission for H-1B immigrants.
• Offer increase guidance on job flexibility provisions for H-1B workers seeking other H-1B Employment, which include changing jobs or employers.   
• For few nonimmigrant workers, it does plan to provide extended grace period for whom period of authorized stay has been expired, including their jobs have been terminated to allow them get other employment without losing their nomination status.
• Should clarify as to when the H-1B nonimmigrants may start working without essential licensure.
• Provide  more amount of  guidance for maximum period of admission for H-1B nonimmigrants which does include all those who are on the path to LPR status and it helps H-1B nonimmigrants to recapture the amount of time spent outside US
• Clarify as to Which H-1B non-immigrants are exempt from the statutory cap to ensure that those nonimmigrants who are contributing to US research as well as education of American may remain in US.
• It helps in Protecting the H-1B nonimmigrants who have suffered retaliatory actions due to reported labor violations committed by their employer.
