U.S Figures Out New Regulations For H-1B Working Visa Holders

The United States government outlined new visa regulations for H-1B Working-Visa Holders making the application procedure much costlier and potentially pricing companies millions of dollars. As per the new draft of the nation, all the potential H-1B visa holders are now recommended to lodge an advanced visa application with a Labor Condition Application in case an overseas employee desires to transfer to a work location outside the region covered by the original visa.

Furthermore, an employee is asked to pay 325 dollars to lodge a modified H-1B application with the United States Citizenship and Immigration Service. Earlier, prospective H-1B holders were recommended to file an LCA with the Department of Labor when they aspire to change the work location, and there was no fee for lodging an LCA.

Once the altered visa request is being filed, an overseas employee can straight away start their regular work at the new area, said the concerned officials of the nation in the new draft guideline that has been issued on 27 May 2014. As per the new reports, the respective officials have planned to look for further comments on the draft guidelines till 26 June, after which they are anticipated to come into force.

Few of the concerned representatives have also noted that the new outline is expensive and extremely troubling for US and Indian IT-consulting firms. Sources added that more number of H-1B petitions need to be lodged by potential employers. India industry representatives have also noted that the new amendment would ratchet up the price of holding workers in the U.S. As per the new estimation of concerned analysts, around 30,000 Indian H-1B visa holders are working in the province and often aspire to change their working location as they move from one project to another.

Each time when a potential worker changes their location, their application process fee approximately cost around 1000 dollars noted the proponents. This new advancement will be applicable for all H-1B visa holders who have changed their working location before 21 May when the USCIS has given a web alert about the modification. All the prospective visa holders who have changed their site after 21 May 2015 are requested to submit the new altered applications. The immigration agency of the nation has declared the last date as 19 August to file the new applications.
