The Home Office published its Immigration Bill details and following are the key points to bear in mind for foreign nationals.
Cutting the right of appeal
The New Bill cuts the right of appeal against decisions on migration so that such rights are held only in response to 4 types of decision rather than 17 as was previously applicable. This has been thought about for some time now and it is mostly motivated by the desire to divest costs from the procedure of appeals.
Essentially, the 4 types of decisions where applicants can have a right of appeal are: leave on the basis of human rights, where refugee status or humanitarian protection is revoked or when refused asylum.
System of administrative review will replace appeals against every other type of decision. Ensuring the application for leaving or entering the country has no room for error is advised to all the applicants.
Extending the ability to deport foreign nationals
The Bill proposed and extension to the range of 'non-suspensive appeals', which means, an appeal hearing will be held after the Home Office deports immigrants first. This can be avoided, however, only in cases where there is a prospect of 'irreversible harm' by deporting someone first.
Paying for healthcare
Earlier this year, making non-EEA migrant individuals pay for healthcare has been a subject of contention. This is a proposal that, if passed, prospective employers interested in hiring migrants and said prospective migrants to the UK need to keep in mind.
Further checks
The Bill also proposes immigration status checks by banks, the DVLA and landlords.
