USA Announced Additional 30,000 H-2B Temporary Worker Visas For 2019
13 May 2019
On May 6, 2019, the US Department of Homeland Security and Department of Labor announced a joint notification stating that availability of an extra 30,000 H-2B temporary worker visas will be offered for the financial year 2019. Please see the following highlights of the notification as described by the New York immigration lawyer.
It is essential to note that the extra 30,000 H-2B visas will be accessible only to returning workers who were given H-2B status or H-2B visas in the previous three financial years.
US Government Plan
The government will prioritize appealing US employers whose businesses will suffer irreparable harm if not issued the requested amount of H-2B visas. In order to get priority treatment, the US business petitioners will have to declare under penalty of perjury that their company will suffer permanent and critical financial loss if they are not given the demanded H-2B visas.
Although the US business petitioner is not needed to present proof of irreparable harm at the point of filing, the Department of Labor, Department of State, and/or Homeland Security Department may ask such evidence at the following stage so the US employer must arrange the proof.
If you are an employer in the US who have requested for an H-2B visa or are an H-2B visa aspirant, we suggest you approach an experienced work-based immigration lawyer to identify the influence of this declaration on your immigration case. If you are applying for an H-2B visa suggest you approach an experienced immigration law firm office which assists you in a better way.
