Job Offers For Canada Express Entry Immigration

Job Offers in Express Entry immigration programs have been a confusing subject for several applicants and are a common reason for their refusal. Unrepresented applicants have claimed 50 more points (in a NOC, 0, A or B position) or 200 points in an executive managerial position of NOC 00, for arranged employment offers of but their job offers and work permits do not support such claims.

Norms

The position of having a valid work permit, and a candidate is presently working for an employer in Canada in a skilled occupation, and that an Employer is extending a job offer for supporting PR application does not mean that the job offer answers to the instructions laid out by the Ministry and meets the Immigration Regulations.

Categories

There are categories of eligible job offers firstly based on LMIA and the next is those which are LMIA exempt.

LMIA based offers of employment further have these subcategories:

•   The candidate accepts a job offer from an employer on a new LMIA which is positive but is not yet working for the said employer.

•   The candidate presently works on a work permit in Canada which was issued on the basis of an LMIA and he/she is working for an employer who is named in the work permit, and he/she is authorized to work on the day of applying for PR visa and when it is issued, the present employer makes an offer to offer a full-time job for one year, in case the PR application stands approved.

LMIA EXEMPTIONS:

Employment offers where LMIA is exempt can be made through:

• An employer whose name appears on work permit issued in the authority of subsections 204(A) or (C) or section 205 of the IRPR, and

• The candidate is presently working for the employer who makes the offer, and

• The candidate has been working continuously for that employer for 12 months in a full-time capacity before submitting the application.

MORE CATEGORIES

• The work permit stands issued under an International Agreement or Non-Trade Agreements. This includes Traders, Professionals, and And Investors.

• The work permit stands issued between Canada and a province/territory.

• This includes exemptions for Canadian interests reasons like giving significant benefit where the employer establishes the fact that hiring a candidate brings important economic, social and cultural, benefits to Canada. There are a few categories included in it.
• Reciprocal employment which permits overseas workers to work in Canada when Canadians are given such opportunities in other nations

• This includes professional coaches, athletes, youth and young professionals, professors and guest/visiting lecturers, academics, including researchers, designated by the Minister, visiting professors, medical residents, and fellows; post-doctoral fellows and professionals winning academic awards from schools based in Canadian, apart from some Charity and religious workers,

(All these LMIA exemptions need a work permit)

MORE DETAILS:

The Ministerial Instructions do not distinguish offers which are extended to the candidates work in Canada for one year on Canada open work permits or those who are authorized to work without a work permit.

• In addition, the job offer must be in writing.
• It must not be issued from a high commission, embassy, or consulate based in Canada, and
• It must provide details of the job like the pay and deductions, job duties, Conditions of the job, and hours of work.

It should be noted that a work permit is not a job offer.

The norms for an offer of employment to qualify in the Federal Skilled Workers Class and Canadian Experience Class vary from the norms in the Federal Skilled Trades Class.
